Simplifying EU administrative law

On 1 September 2014, the results of a 5-year research project of the Research Network on EU Administrative Law initiated and coordinated by Professor Herwig Hofmann of the University of Luxembourg have been published online.

Over 100 researchers from all over Europe and beyond cooperated in creating the Model Rules on EU Administrative Procedure which have been discussed at major conferences in Luxembourg and at the European Parliament in Brussels.

The objective of the ReNEUAL project was to improve implementation of European Union law and policies whilst ensuring that the constitutional values of the Union are present and compliedwithin all instances of exercise of public authority.

It aims at contributing to a legal framework for implementation of EU law by non-legislative means through a set of accessible, functional and transparent rules which make visible rights and duties of individuals and administrations alike.

The Model Rules on EU Administrative Procedure are proof that it is possible to draft an EU regulation of administrative procedures adapted to the sometimes complex realities of implementing EU law by Union bodies and Member States in cooperation.

The project benefited from financial support by public research funds such as the Fonds National de la Recherche, from Luxembourg and their partner organisations from Germany, Spain, Italy and the Netherlands and many universities and academic organisations including the European Law Institute and the Institut Universitaire International du Luxembourg.

I think all can be proud of the result which will influence the political debate on procedural rights and good governance in the EU in the coming years” Professor Herwig Hofmann commented. “The European Parliament has called for legislation in this field. The ReNEUAL project sets the parameters of what needs to be taken into account and makes realistic proposals which allow the EU to move towards a simplified and more accountable and exercise of public powers.”

The results will be published in book-form in English with translations to Spanish, Italian, French, German and Polish in preparation.
